'UPDATE FROM COURT OF APPEAL
Court of Panel told Biyi Poroye and Jimoh Ibrahim that application for stay of proceedings filed at d Supreme Court cannot stop d proceedings of d substantive appeal. They said d Supreme Court in a recent judgment has said that interlocutory appeal from court of appeal to d supreme court shld not stay d proceedings of d substantive appeal. D panel therefore threw out d application by Biyi Poroye counsel that since have an application for stay at supreme court, that d court of appeal shld stop sitting on d appeal.
When Jimoh Ibrahim discovered that their attempt to stop d panel has failed, he informed d court that he has an application for joinder. D panel asked him to move his application and that they will rule on it immediately. At that point, Jimoh Ibrahim counsel withdrew his appearance from d case. D panel immediately asked parties to adopt their brief of argument. Eyitayo Jegede counsel immediately adopted his brief of argument. Biyi Poroye counsel has no brief to adopt since he did not file any, when he ought to file.
Biyi Poroye counsel is now begging to b given time to file his brief which plea d panel refused. Date for judgment will b fixed today.
